Why couples sign prenups
A prenup is a planning tool — not a prediction
A prenuptial agreement lets you decide together, while you’re on the same side, how finances will be handled during the marriage and if it ever ends. For many couples it’s simply a responsible part of planning a life together.
- Protect premarital assets, savings, and investments
- Protect a business or professional practice
- Keep inheritances and family property separate
- Plan for children from a prior relationship
- Clarify responsibility for existing debts
- Set expectations about alimony
What Florida law requires
- The agreement must be in writing and signed by both parties.
- Each person should give fair and reasonable disclosure of their assets, debts, and income.
- It must be entered into voluntarily — without fraud, duress, or coercion.
- It cannot limit a child’s right to support.
Signing well before the wedding — and giving each person time to have their own attorney review it — helps protect the agreement.
