Prenuptial Agreements in Florida

Plan the marriage, not the divorce. An attorney-drafted prenuptial agreement gives you both clarity about property, debts, and support — before you say “I do.”

We draft and review prenups for couples in Eustis, Winter Park, Maitland, Windermere, Dr. Phillips, Lake Mary, Heathrow, Winter Garden, Horizon West, Ocoee and Orlando, including Baldwin Park, College Park, Lake Nona and downtown, and we help couples in The Villages, Lady Lake and Mount Dora with prenups for remarriage.

Why couples sign prenups

A prenup is a planning tool — not a prediction

A prenuptial agreement lets you decide together, while you’re on the same side, how finances will be handled during the marriage and if it ever ends. For many couples it’s simply a responsible part of planning a life together.

What Florida law requires

  • The agreement must be in writing and signed by both parties.
  • Each person should give fair and reasonable disclosure of their assets, debts, and income.
  • It must be entered into voluntarily — without fraud, duress, or coercion.
  • It cannot limit a child’s right to support.

Signing well before the wedding — and giving each person time to have their own attorney review it — helps protect the agreement.

The process

How a prenup comes together

STEP 1Strategy consultation

We talk through your goals, your assets, and what matters most to you both.

STEP 2Financial disclosure

You each prepare disclosure schedules of assets, debts, and income.

STEP 3Attorney drafting

Your attorney drafts a customized agreement under Florida law.

STEP 4Review & revise

You review the draft with your attorney and request revisions. Your fiancé(e) has it reviewed by their own lawyer.

STEP 5Signing

You both sign — ideally well before the wedding — and receive your finalized agreement.

Questions

Prenuptial agreement FAQs

As early as possible. Starting two to three months before the wedding gives time for disclosure, review by each person’s attorney, and revisions — and signing well in advance helps show the agreement was voluntary.

An attorney can represent only one of you. Florida doesn’t strictly require both parties to have counsel, but independent review for each person is strongly recommended and makes the agreement harder to challenge.

Yes. Florida law allows you to waive or include alimony as part of your prenuptial agreement. Your attorney will explain how these provisions work and what’s appropriate for your situation.

No. Parenting and child-support decisions are based on the child’s best interests at the time, and a prenup cannot reduce a child’s right to support.

Have it reviewed by your own attorney before you sign. Our Prenup Review™ explains what the agreement means, what rights you would be giving up, and what changes you should ask for.
